Terms of Service

These Terms of Service (“Terms”) are a binding agreement between you and ZZEN, Inc. [replace with registered legal entity name](“ZZEN”) governing your use of stayzzen.com, zzenadvertise.com, and related services (the “Services”). By creating an account or using the Services you accept these Terms and our Privacy Policy. If you do not agree, do not use the Services.

ZZEN is a marketplace that connects hosts offering short-term rental accommodations with guests. ZZEN is not a party to any rental agreement between hosts and guests, does not own or manage listed properties, and does not guarantee the condition, legality, or suitability of any listing. Hosts are independent operators, not employees or agents of ZZEN.

You must be at least 18 years old to create an account. You are responsible for the accuracy of the information you provide and for all activity under your account. Keep your credentials confidential and notify us immediately of any unauthorized use.

Hosts are solely responsible for their listings, including accuracy of descriptions and photos, pricing, availability, compliance with all applicable laws (zoning, permits, registration, occupancy taxes, short-term rental ordinances), and the safety and habitability of their properties. Hosts must honor confirmed bookings except where cancellation is permitted by their stated policy.

Host subscriptions are billed monthly (Property Card and Portfolio plans, with introductory pricing as displayed at /pricing). A payment processing fee of 2.25% applies to booking transactions (1.25% for hosts who opt out of the rewards program). Prices may change with at least 30 days’ notice. Subscriptions may be cancelled at any time and remain active through the end of the billing period; fees already paid are non-refundable except where required by law.

Payments are processed by our third-party payment processor. When you book, you authorize the charge for the total price shown. Cancellation and refund terms are set by each host’s cancellation policy as displayed on the listing at the time of booking. Chargebacks filed in bad faith may result in account suspension.

Like a hotel, guests are responsible for the property during their stay. You agree to leave the property in the condition you received it, ordinary wear and tear excepted, and you are financially responsible for loss or damage caused during your stay by you or your invitees — including damage to the property, its furnishings and contents, missing items, excessive cleaning, smoking or pet violations where prohibited, unauthorized guests or events, and any resulting fines or third-party claims (“incidentals”).

Hosts may require a refundable damage deposit or place a temporary authorization hold on your payment method for a stay, disclosed before you book. By booking, you authorize ZZEN and its payment processor to charge your payment method on file for substantiated incidentals up to the amount disclosed, or, where no cap is disclosed, for the reasonable, documented cost of the damage. Hosts must report and document incidentals within 14 days of checkout, and you will have an opportunity to respond before any charge is finalized. Charges are limited to actual, itemized costs — not punitive amounts — and you may dispute them through ZZEN’s resolution process.

Vehicle add-ons.Where a host offers a vehicle rental (boat, cart, ATV, car, and similar), you must carry valid insurance for the rental — your own policy, or coverage purchased through ZZEN at checkout — and hold a valid license where one is required. Coverage sold through ZZEN is provided by a licensed insurer and subject to that policy’s terms, limits, and deductible. You are responsible for damage, theft, citations, tolls, and injury arising from your use of a rented vehicle to the extent not covered by the applicable policy, and for any deductible.

Guests earn 10 points per $1 spent on eligible bookings; 1,000 points redeem for $1 of booking credit. Points never expire but have no cash value, are non-transferable, and are void where prohibited. Bookings on properties whose hosts have opted out of the rewards program do not earn points. We may modify or terminate the program with reasonable notice; earned points will remain redeemable for at least 12 months after any termination notice.

You may not: misrepresent listings or your identity; circumvent the platform to avoid fees; scrape or harvest data; interfere with the Services’ operation or security; use the Services for any unlawful purpose, including discrimination prohibited by fair-housing laws; or post content that is fraudulent, defamatory, or infringing. We may remove content and suspend or terminate accounts that violate these Terms.

You retain ownership of content you post (photos, descriptions, reviews) and grant ZZEN a worldwide, non-exclusive, royalty-free license to host, display, and promote it in connection with the Services. You represent that you have the rights to the content you post. Reviews must reflect genuine experiences; we may moderate or remove reviews that violate our policies.

The Services are provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. ZZEN does not warrant that the Services will be uninterrupted, secure, or error-free, and makes no warranty regarding any listing, host, or guest.

To the maximum extent permitted by law, ZZEN’s total liability for any claim arising out of or relating to the Services is limited to the greater of $100 or the amounts you paid to ZZEN in the 12 months preceding the claim. ZZEN is not liable for indirect, incidental, special, consequential, or punitive damages, or for the acts or omissions of hosts or guests. Some jurisdictions do not allow these limitations, so they may not apply to you.

You will indemnify and hold ZZEN harmless from claims arising out of your use of the Services, your content, your violation of these Terms, or your violation of any law or third-party right — including, for hosts, claims arising from your listings and guest stays.

You may close your account at any time. We may suspend or terminate your access for violation of these Terms, fraud, or risk to other users, with notice where practicable. Sections that by their nature should survive termination (including 7 and 10–13 and 15) survive.

These Terms are governed by the laws of [State], United States, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in [State], United States, and each party consents to their jurisdiction. Nothing in this section limits rights that consumers have under mandatory local law.
